Terms and Conditions of Sale

1. Preamble and scope

These Terms and Conditions of Sale (hereafter “Terms”) apply to all sales made on this website (hereafter “the Site”) by My Spices Land, a SARL (French limited liability company) with share capital of €3,000, registered with the Nice Trade Register under number 990 528 275, with registered office at 1 Rue du Malonat, 06300 Nice, represented by its managers Mr. Julien Mattera and Mr. Cédric Valleix.

Any order placed on the Site implies unreserved acceptance of these Terms. My Spices Land reserves the right to modify the Terms at any time; the applicable conditions are those in effect on the day of the order.

2. Products and services

The Site offers for sale vanilla, spices, essential oils, natural cosmetic products and other exceptional foodstuffs, directly imported from Madagascar. Products are described as accurately as possible, but photographs and illustrations are for indicative purposes only.

Product offers are valid as long as they are visible on the Site, within the limits of available stock. In the event of unavailability after ordering, the customer is informed and may obtain a refund or credit note.

3. Prices and VAT

Prices are shown in euros, all taxes included. Pursuant to Article 293 B of the French General Tax Code, My Spices Land benefits from the VAT exemption scheme and is therefore not subject to VAT. No VAT amount is charged on products or shipping costs.

My Spices Land reserves the right to change its prices at any time; products are invoiced based on the prices in effect at the time the order is recorded.

Promotional offers and tiered pricing for professionals are available upon presentation of supporting documentation or via the dedicated professional space.

4. Order and payment

Orders are placed via the Site's online process. The customer selects products, adds them to the cart, provides their details, and chooses their delivery and payment method. Order confirmation constitutes a firm and definitive commitment.

Accepted payment methods are: credit card (via Stripe), bank transfer, and any other method indicated on the Site. Payment is immediate and secure. In the event of non-payment, the order is cancelled.

5. Delivery

Products are delivered to the address provided by the customer, in mainland France, French overseas territories, and internationally depending on available zones. Delivery times are expressed in business days and begin upon payment confirmation.

My Spices Land strives to meet stated delivery times but cannot be held liable for delays attributable to the carrier or exceptional circumstances (force majeure). Delivery costs are detailed before order confirmation.

The customer must inspect the condition of products upon delivery and raise any justified objection within 3 business days.

6. Right of withdrawal

Pursuant to Article L.221-18 of the French Consumer Code, the customer has 14 days from receipt of the products to exercise their right of withdrawal, without having to justify a reason or pay a penalty. Products must be returned in their original condition, complete and unopened (except for opened foodstuffs, which cannot be returned for hygiene reasons).

Return shipping costs are borne by the customer. Refunds are issued within 14 days of receiving the returned products, using the same payment method used for the purchase.

Excluded from the right of withdrawal: perishable goods, and products unsealed after delivery that cannot be returned for hygiene or health protection reasons (notably loose spices, seeds, etc.).

7. Warranties

All products benefit from the statutory warranty of conformity (Articles L.217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code). My Spices Land undertakes to refund or replace defective or non-conforming products, following review by our customer service team.

8. Liability

My Spices Land implements all reasonable means to ensure transaction security and the quality of information provided. However, My Spices Land's liability cannot be engaged in the event of non-performance of the contract due to force majeure, an act of the customer, or interruption of transport or payment services.

9. Intellectual property

All elements of the Site (text, images, logos, videos) are the exclusive property of My Spices Land or its partners. Any reproduction, representation or use without authorization is prohibited and constitutes infringement.

10. Personal data and cookies

Information collected during ordering is necessary for managing the customer relationship and fulfilling the contract. In accordance with the French Data Protection Act and the GDPR, the customer has rights of access, rectification and objection. For more information, see our Privacy Policy.

The Site uses cookies to improve user experience and generate traffic statistics. The customer can manage their preferences via their browser.

11. Governing law and disputes

These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action. The customer may resort to conventional mediation or the European Commission's online dispute resolution platform (ODR). Failing an amicable agreement, the competent courts are those within the jurisdiction of the Nice Court of Appeal.
